USER AGREEMENT
This user agreement (“Agreement”) is an agreement between you and Namastey Flix, the owner of the Namastey Flix brand (“Namastey Flix” or “we” or “us” as the context requires) governing your use of Namastey Flix Website/Application and/or any of its services. By accessing the Application and the website at your sole discretion, registering and using our services as a visitor or as a registered member, you agree to be bound by this Agreement and all the terms mentioned herein. This User Agreement governs your access to the Mobile Application, website, any/all of the services (programs) offered by Namastey Flix under the Namastey Flix brand and shall apply to all the users, visitors, and the ones who access the use of this Mobile Application and website www.namasteyflix.com and any of our services.
1. SERVICES PROVIDED
Namastey Flix, a brand owned by Namastey Flix, provides a personalized subscription service that allows our members to access Films, Short Films, Web Series, and TV shows ("Namastey Flix Content") over the Internet on certain Internet-connected TVs, computers, and other devices.
2. Login Process and Collection of Information
We have recently updated our login process. Users are now required to enter their mobile number for authentication. Upon entering their mobile number, users will receive a one-time password (OTP) for login verification. By using this login method, you consent to the collection of your mobile number for authentication and login verification purposes only.
3. SUBSCRIPTION AND REGISTRATION
- www.namasteyflix.com Subscription: www.namasteyflix.com You will be solely responsible for obtaining and maintaining the Device and Internet connection needed in order to access and use Namastey Flix Content and paying for all such charges in relation thereto.
www.namasteyflix.com Registration: www.namasteyflix.com To register for the Namastey Flix Website/Application, you shall be required to sign up by completing the registration process by providing basic contact details; You shall also choose a password and a user name.
4. PAYMENT AND BILLING
The subscription fee for the Namastey Flix services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the "Account" page.
5. CONTENT USAGE
The Namastey Flix service and any content viewed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household.
6. AGE RESTRICTIONS
You must be at least 18 years of age to become a member of the Namastey Flix service. Minors may only use the service under the supervision of an adult.
7. DISCLAIMERS
The information shared on this Mobile Application and on the website is general information provided by Namastey Flix under the Namastey Flix brand. While we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied.
8. GOVERNING LAW & DISPUTE RESOLUTION
By subscribing to our services and by using the Website/Application, you agree, as we do, that only the Courts in Mumbai, India shall have exclusive jurisdiction for claims arising out of or relating to these terms and conditions and/or all the Service provided by Namastey Flix under the Namastey Flix brand.
9. NOTICES
Any notices or other communications required will be in writing and emailed to Namastey Flix at info@namasteyflix.com.
10. ARBITRATION
Any dispute, claim, or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate, or your use of the Website/Application, Namastey Flix services, or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by Namastey Flix. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Mumbai.
11. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Namastey Flix relating to the website/Application and supersedes all prior or contemporaneous oral or written communications including but not limited to any terms and conditions of purchase, proposals, and representations with respect to the Application or any other subject matter covered by this Agreement.
12. SEVERABILITY CLAUSE
If any provisions of this Agreement are held to be void, invalid, unenforceable, or illegal by a court of competent jurisdiction then other such provisions shall be set aside and the remaining provisions shall continue in full force and effect.
